DMCA Policy

At WideScope, we respect the intellectual property rights of others and expect our users to do the same. In compliance with the Digital Millennium Copyright Act (DMCA), it is our policy to respond to valid notifications of copyright infringement and take appropriate action where necessary. This policy outlines our commitment to protecting copyrighted content and explains how copyright holders can submit claims if they believe their content has been used without permission.

What is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a U.S. copyright law that provides protection for copyright owners by establishing a process for addressing copyright infringement online. It requires online service providers, such as websites, to respond to takedown requests from copyright holders and take down content that infringes on copyrights.

Filing a DMCA Complaint

If you are a copyright holder and believe that your content has been posted on WideScope without your authorization, you may submit a DMCA notice to request the removal of the infringing content. To file a DMCA complaint, please provide the following information:

  1. Identification of the Copyrighted Work: Describe the copyrighted work you believe has been infringed. If multiple works are affected, please list each one clearly.
  2. Identification of the Infringing Material: Include a detailed description of where the alleged infringing material is located on our website, such as the URL or specific location of the content.
  3. Your Contact Information: Provide your name, mailing address, telephone number, and email address.
  4. A Statement of Good Faith: Include a statement indicating that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy and Authority: A statement affirming that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Your Physical or Electronic Signature: Sign the notice electronically or physically.

Once we receive a DMCA-compliant notification, we will promptly investigate the claim and, if valid, remove or disable access to the infringing content.

Counter-Notification Procedure

If you believe that content you posted on WideScope was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification. This should include:

  1. Identification of the Material: Describe the material that has been removed or disabled and the location at which the material appeared before it was removed.
  2. A Statement of Good Faith: Include a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your Contact Information: Provide your name, address, telephone number, and email address.
  4. Consent to Jurisdiction: Include a statement that you consent to the jurisdiction of the federal court in your district (or the jurisdiction where you are located if outside the United States) and that you will accept service of process from the person who provided the original DMCA notice.
  5. Your Physical or Electronic Signature: Sign the counter-notification electronically or physically.

Upon receiving a valid counter-notification, we may restore the removed content within 10-14 business days unless the original copyright holder files a court action against you to prevent restoration.

Repeat Infringement Policy

WideScope reserves the right to terminate user accounts that are repeat infringers of copyright or otherwise violate our terms of service.
